Terms and Conditions

These terms are the rules for using the WeRoam app and website. By creating an account or using WeRoam, you agree to them, so please read them. If you don't agree, please don't use WeRoam.

1.About these terms

WeRoam is run by Active AI Ltd (“we”, “us”, “our”), a company registered in England and Wales (company number 16499926), with its registered office at The Rockery, Shap, Penrith, CA10 3LY.

WeRoam is delivered in partnership with Kent County Council and funded by the UK Government. These terms are an agreement between you and Active AI Ltd. They cover the WeRoam mobile app, the website at weroamapp.com, and our emails and related services (together, “WeRoam”).

How your personal data is used is explained in the WeRoam privacy notice, and our use of cookies in our cookie policy. Our FAQs explain how WeRoam works day to day. If the FAQs and these terms ever disagree, these terms apply.

2.Who can use WeRoam

You must be 18 or over and live in the UK to create an account. WeRoam is a pilot focused on Kent, so markers, challenges and partner rewards are mainly in Kent, but you can use the app wherever you are in the UK.

WeRoam is free to download and use. We won't charge you for the core app.

3.Your account

• Give us accurate details when you sign up, and keep them up to date. Some features rely on them: for example, the postcode on your profile decides which town you represent in town challenges.
• Confirm your email address. Until you do, you won't be added to challenges.
• One account per person. Don't create an account for anyone else or share yours.
• Keep your login details safe. You're responsible for what happens on your account, so tell us straight away if you think someone else has used it.

4.How WeRoam works

WeRoam rewards you for moving under your own steam. You earn points in three ways:

• Activities: walks, wheels and rides you track, either with the record feature in the app or in a connected app such as Strava or Apple Health. WeRoam doesn't count steps and tracks nothing in the background. Only activities you choose to track count.
• Roam Markers: points on the WeRoam map that you collect by going to them. Some are always there; others appear for a limited time.
• Challenges: goals over a set period, such as a number of active minutes in a week.

5.Fair play

WeRoam only works if everyone plays fair. Points must come from activity you genuinely did yourself by walking, wheeling (including using a wheelchair, mobility aid or pushchair), cycling or scooting. You must not:

• log activity done in a car, on public transport or on any motorised vehicle (other than a powered wheelchair or mobility scooter you use as a mobility aid);
• fake or tamper with your location or activity, for example with GPS spoofing, emulators, bots or edited files;
• log activity done by someone else, or have more than one account;
• use any bug or error to earn points or rewards you wouldn't otherwise have earned. If you spot one, please tell us.

If we reasonably believe these rules have been broken, we may remove points or rewards, take you off leaderboards or out of challenges, or suspend or close your account. We'll tell you if we do, and you can ask us to look at it again.

6.Points, levels and challenges

• Points and levels are for fun and motivation. They have no cash value, can't be exchanged for money and can't be transferred to anyone else.
• We may change how points are earned, what levels need, and how challenges are scored. Changes apply from when we make them, not backwards, unless we are correcting a mistake.
• We may correct your points, level or challenge progress if something has been recorded wrongly, whether in your favour or not.
• When you confirm your email, we automatically add you to our open challenges. You can leave any challenge at any time, and rejoin it if you change your mind. Some special challenges must be joined separately.
• Each challenge has its own dates and rules, shown in the app or on our website. If they differ from these terms, the challenge rules apply to that challenge.

7.Partner rewards

Local businesses and organisations (our “partners”) offer rewards, such as a free drink or a discount, that you can unlock in WeRoam, for example by collecting a marker or completing a challenge.

Claiming a reward

• Rewards can only be unlocked while they are live in the app. Once unlocked, a reward appears in My Rewards.
• To claim it, show the reward in the app to staff at the partner venue, during its normal opening hours and before the claim deadline shown with the reward. Staff may ask to see your screen, but they don't need to take your phone.
• Rewards are one per person per offer, unless the reward says otherwise. Any conditions, such as a minimum spend, are shown with the reward.
• Some rewards are limited in number, and are available while they last.

Good to know

• Rewards have no cash value, can't be exchanged for cash and can't be transferred.
• The partner provides the reward and is responsible for it, including its quality and any allergen information. Partners agree to our Reward Partner Terms.
• A partner may refuse a reward that has already been claimed, has passed its deadline, was unlocked outside the dates it was live, or where they reasonably suspect misuse.
• We never give partners your name, contact details, location or activity data. You never have to give a partner your details, join a mailing list or follow anyone on social media to claim a reward. If you choose to share your details with a partner, their own privacy policy applies.
• If a partner can't honour a reward you were entitled to, please contact us and we'll help put it right.

8.Prize draws and competitions

From time to time we may run prize draws or competitions. Each one will have its own rules, published before it starts, explaining who can enter, how winners are chosen and what the prize is. Those rules apply alongside these terms. Entry will always be free.

9.Leaderboards, groups and posts

Some parts of WeRoam are shared with other users. Your display name, profile picture, level and challenge progress may appear on leaderboards and in groups you join. Town challenges show totals for each town, never your individual activity alongside your address. Choose a display name and picture you're happy for others to see.

When you post, comment or create a group, be kind and keep WeRoam welcoming for everyone. Don't post anything that is unlawful, abusive, discriminatory, sexual, misleading or that you don't have the right to share, or that shares someone else's personal information. Don't use WeRoam to advertise or sell.

We may remove content or groups that break these rules. If you see something that shouldn't be there, please tell us.

10.Connected apps

You can connect apps such as Strava or Apple Health so that activities you track there are added to WeRoam automatically. Connecting an app is optional, and you can disconnect it at any time. Those apps have their own terms and privacy policies, which apply to your use of them. We aren't responsible for them, and we can't guarantee that every activity will sync, or sync straight away.

11.Staying safe

Getting outside should be enjoyable and safe, and you're responsible for your own safety while using WeRoam.

• Follow the Highway Code and local rules, and be aware of your surroundings.
• Don't look at or use your phone while cycling or crossing roads. Stop somewhere safe first.
• We aim to place markers in public, accessible places. Don't enter private land, cross railways, go near water's edges or cliffs, or go anywhere that feels unsafe to reach a marker. If a marker looks wrongly placed or unsafe, please report it and we'll check it.
• Dress for the weather, and let someone know where you're going if you're heading somewhere quiet.

WeRoam is not a medical or health service. If you have a health condition, or are unsure whether more activity is right for you, check with a healthcare professional first.

12.Your data

The WeRoam privacy notice explains what personal data is collected, why, who it is shared with, and your rights. In short: we only collect what we need to run WeRoam, we never sell your data, and we use your location to power tracking and markers, not to follow you. To help show whether the pilot works, we share anonymised, combined figures with Kent County Council and our funders. These never identify you.

13.Changes to WeRoam

WeRoam is a pilot, and we're always improving it based on what users tell us. We may add, change or remove features, markers, challenges and rewards. We'll try to keep things running smoothly, but we can't promise WeRoam will always be available or free from errors, and we may need to pause it for maintenance.

WeRoam is publicly funded, and the service may change significantly or end if that funding changes. If we plan to close WeRoam, we'll give you at least 30 days' notice by email or in the app where we can. Points and levels have no value once the service ends, so please claim any unlocked rewards before then.

14.Our content and yours

The WeRoam name, logo, app, website, maps and other content belong to us or the people we license them from. You may use the app for your own personal, non-commercial use. Please don't copy, change, resell or try to reverse-engineer any part of WeRoam, or place unreasonable load on it.

Anything you post, such as photos, comments or profile details, stays yours. By posting it, you allow us to store and display it within WeRoam so we can run the service. If you'd like us to use something you've posted in our own promotion, such as on social media, we'll ask you first.

15.Our responsibility to you

We provide WeRoam with reasonable care and skill. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit, and nothing affects your legal rights as a consumer.

Because WeRoam is free, and apart from the above, we aren't responsible for losses that weren't reasonably foreseeable, for losses caused by you breaking these terms, or for things outside our reasonable control, such as mobile network, app store or connected app outages. We aren't responsible for partner rewards, which the partner provides (see section 7), or for websites and services we link to.

16.Suspending or closing accounts

You can stop using WeRoam at any time, and you can delete your account yourself in the app whenever you like. If you need help, contact us. When your account is closed, your points, levels and any unclaimed rewards are lost.

We may suspend or close your account if you seriously or repeatedly break these terms, or if we need to for legal or safety reasons. Unless the reason makes it inappropriate, we'll tell you first and explain why.

17.Changes to these terms

We may update these terms, for example when we add features or the law changes. If we make an important change, we'll tell you by email or in the app at least 14 days before it takes effect. If you don't agree, you can close your account. If you keep using WeRoam after the change takes effect, the new terms will apply.

18.The legal bits

• These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring them in your local courts.
• If any part of these terms is found to be unenforceable, the rest still applies.
• We may transfer our rights and responsibilities under these terms to another organisation that takes over running WeRoam. We'll tell you if this happens, and it won't reduce your rights.
• Only you and we have rights under these terms. Kent County Council and our partners are not parties to them.
• If we don't enforce a term straight away, we can still enforce it later.
